Terms of Service

These Terms of Service (“Terms”) govern your access to and use of World Tour Planner (“the Service”), operated by Beren Software (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old to use the Service. To access most features you must create an account with a valid email address. You are responsible for providing accurate registration details and for keeping them up to date. Accounts are personal to you.

2. Your responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect any unauthorised use. You agree to use the Service in compliance with these Terms and all applicable laws.

3. Acceptable use

When using the Service, you agree that you will not:

  • upload or share unlawful, infringing, deceptive, offensive or harmful content in any field (including tour names, descriptions and notes);
  • attempt to access accounts, data or systems that do not belong to you, or bypass authentication or security measures;
  • interfere with, overload, disrupt or attempt to reverse-engineer the Service or its infrastructure;
  • use automated means to scrape, harvest or place excessive load on the Service without our prior written consent;
  • use the Service to distribute malware, spam or other unsolicited communications.

4. Your content

You retain ownership of the content you create in the Service. You grant us a limited, non-exclusive, worldwide licence to host, store, process and display that content solely as needed to operate and provide the Service to you and to the people you choose to share it with. You are responsible for the content you submit and for ensuring you have the rights to it.

When you publish a tour, share a link or invite collaborators, you allow others to view and copy that content within the Service. You are responsible for what you choose to make public or share.

5. Intellectual property

The Service, including its software, design, branding and original content, is owned by Beren Software and protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred. You may not copy, modify, distribute or create derivative works of the Service without our permission.

6. Third-party services and data

The Service integrates with and references third parties, including flight simulators, SimBrief, OurAirports and aviation weather sources. World Tour Planner is not affiliated with, endorsed by or sponsored by Microsoft or any of these providers; their names and data are used for interoperability and reference only. Your use of third-party services is subject to their own terms.

7. Not for operational use — disclaimer

The Service is provided for flight-simulation planning and record-keeping only. Distances, headings, flight-time estimates, range figures, weather and other data are approximate and provided for entertainment and planning purposes. They must not be used for real-world flight planning, navigation or any operational aviation purpose.

8. Warranties and availability

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that data will never be lost. We may modify, suspend or discontinue features at any time. You are responsible for keeping your own copies of any content that is important to you.

9. Limitation of liability

To the fullest extent permitted by law, Beren Software shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of (or inability to use) the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Suspension and termination

You may stop using the Service and delete your account at any time from Settings. We may suspend, limit or terminate your access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

11. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes will be subject to the competent courts of the Netherlands, unless mandatory consumer-protection law provides otherwise.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you through the Service. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
